BOARD OF GOVERNORS ACTIONS
March 10-11, 2003

The Board of Governors of the California Community Colleges took the following actions at its march 10-11, 2003, meeting:

  • Fifty Percent Law Exemptions (Item 4.3) (030103) Approved an exemption for the Copper Mountain Community College District from compliance with the Fifty Percent Law for fiscal year 2001-02.

    Approved an exemption for the Kern Community College District on the basis of comparable salaries, but will hold a discussion on the methodology that was used for the Kern CCD.

  • 2004-05 Capital Outlay Projects (Item 4.4) (930203) Approved the 2004-05 Capital Outlay Projects, as presented.

  • The Real Cost Project: Preliminary Report (Item 4.5) (030303) Approved staff's recommendation on the Real Cost Project as follows:

    1. Accept the preliminary report of the Real Cost Project, including an initial estimate of $9,200 per full-time equivalent student as the real cost of providing a quality education for every student.

    2. Authorize the Chancellor to brief and confer with key legislative and executive branch officials regarding the initial findings of the Real Cost Project.

    3. Direct the Chancellor to return to the Board with a final report and recommended strategy for implementation and advocacy.

  • Resolution in Support of the 2004 Bond Measure (Item 4.6) (030403) Adopted a Resolution in Support of the 2004 Bond Measure. (Attached)

  • Positions on State Legislation (Item 5.1) (030503) Approved the following bills positions:

  • Approval of Contracts and Grants (Item 9) (030603) Approved entering into the Contracts and Grants described in the summary.

  • Title 5 Regulations: Classified Participation in Governance (Item 10) (030703) Adopted the regulations on Classified Participation in Governance, as presented.

  • Partnership for Excellence: Assessment of System Performance (Item 11) (030803) Approved the following staff recommendations:

    1. Determined that the system has achieved the expected goals for 2001-02, pursuant to Board guidelines.

    2. Found that achievement of system goals has been satisfactory, pursuant to subdivision (e) of section 84754 of the Education Code.

    3. Determined that no contingent funding mechanism shall be implemented in the 2003-04 fiscal year, and that funding shall continue to be allocated to districts on an FTES basis.

  • Title 5 Regulations: Release/Reassigned Time for President and Vice President of the Academic Senate (Item 12) (030903) Adopted the Regulations on Release/ Reassigned time for the President and Vice President of the Academic Senate.

  • Title 5 Regulations: Proposed Revisions to the Conflict of Interest Code of the Board of Governors (Item 13) (031003) Adopted the proposed revisions to the Conflict of Interest Code, as presented.

Resolution in Support of the
Kindergarten-University Public Education
Facilities Bond Act of 2004


WHEREAS, Assembly Bill 16 (Stats. 2002, Ch. 33) enacted an education facilities bond measure for the March 2004 primary election ballot that would, if approved by the voters, provide $12.3 billion in bonds to relieve overcrowding, make safety repairs and upgrade California's elementary, middle and high schools, community colleges and universities; and


WHEREAS, More than 2.5 million students are enrolled in the California Community Colleges, and enrollment is projected to increase by at least 500,000 students by the year 2010; and


WHEREAS, Without needed building improvements and additions, California's historic policy of access to higher education is seriously threatened; and


WHEREAS, More than $35 billion per year is contributed to the state's economy through California's three higher education systems, and there is a direct correlation between California's future economic and cultural prosperity and the availability of educational opportunities for its citizens through community colleges and other higher education institutions; and


WHEREAS, the Californians for Accountability and Better Schools support the proposed bond measure because funds must be spent on school construction, not on bureaucracy or wasteful overhead, and projects must comply with strict accountability requirements, including mandatory audits, to safeguard against waste and mismanagement; and


WHEREAS, the bond measure is supported by a large and diverse coalition, including Governor Gray Davis, the California Legislature, the California State PTA, California Teachers Association, Californians for Higher Education, California Building Industry Association, and local teachers across the state;


THEREFORE, BE IT RESOLVED, that the Board of Governors of the California Community Colleges supports and endorses the Kindergarten-University Public Education Facilities Bond Act of 2004 that is slated for the March 2004 primary election.
